INTRODUCTION

1. DEFINITIONS

Activity: Includes all BaseStack Esports gaming activities, such as pay-to-play online gaming, private parties, tournaments, and publisher events.
Agreement: The contract between BaseStack SPV Z.O.O., BaseStack GmbH, or any of their affiliates (“BaseStack”) and the customer, which includes these terms, the waiver, and the privacy policy.
BaseStack: Collectively refers to Base Stack SPV Z.O.O., registered in Poland, and BaseStack GmbH, registered in Germany at An den Grachten 21, 12683 Berlin, VAT No: DE 353963851.
BaseStack Location: Any facility provided by BaseStack for delivering services.
BaseStack Staff: Employees or representatives of BaseStack overseeing activities.
Booking: Reservation made through BaseStack’s online booking system under these terms.
Customer: Anyone purchasing services from BaseStack.
Participant: Individuals partaking in activities at a BaseStack location.
Services: The provision of gaming equipment and facilities for activities.
Waiver: A risk acknowledgement and liability form completed before activities.

2. GENERAL TERMS

2.1 These terms cover all bookings, the waiver, and any related agreements.
2.2 Customers must ensure that all participants are aware of and agree to these terms.
2.3 BaseStack may refuse service or remove participants who breach these terms.
2.4 Any amendments to these terms must be in writing and agreed upon by BaseStack.
2.5 BaseStack may modify services as needed.
2.6 There is no guarantee that the booking system will be uninterrupted.
2.7 The booking system is intended for personal use only.

3. BOOKINGS

3.1 Bookings are confirmed via our online system under these terms.
3.2 Payment is due at booking via BaseStack Wallet or credit/debit card.
3.3 Prices may vary; details are provided during the booking process.
3.4 Cancellations require 28 days’ notice for a full refund; otherwise, rescheduling is possible but refunds are not.

4. CUSTOMER OBLIGATIONS

4.1 Customers and participants must accept these terms and the waiver.
4.2 Participants must check in on time with BaseStack staff.
4.3 BaseStack can refuse entry to latecomers or terminate bookings for non-compliance with safety instructions.

6.1 Refunds are issued to the original payment method or via bank transfer if the card has expired.

7. USE OF INFORMATION

7.1 Information collected is used in service delivery and complies with GDPR and applicable local data protection laws.

8. PHOTOGRAPHY AND RECORDING

8.1 BaseStack owns content created through game streaming and may use it for marketing.
8.2 Restrictions apply to the use of recording devices to ensure privacy.

9. LOST PROPERTY

10.1 Intellectual property from services belongs to BaseStack unless stated otherwise.

11. LIABILITY

11.1 BaseStack is not liable for personal property loss or injury, except as covered by our insurance.

12. INDEMNITY

12.1 Customers indemnify BaseStack against losses due to breaches of these terms.

13. TERMINATION

13.1 BaseStack may terminate services if customers fail to adhere to these terms.

14. FORCE MAJEURE

14.1 BaseStack is not liable for delays or failures caused by uncontrollable events.

15. THIRD PARTY RIGHTS

16. ASSIGNMENT

16.1 Rights under these terms cannot be transferred without BaseStack’s consent.

17. SEVERANCE

17.1 If any part of these terms is unenforceable, the rest remains in effect.

18. GOVERNING LAW
